Terms and Conditions for Remote Queueing
The Ohio Department of Public Safety, Ohio Bureau of Motor Vehicles (BMV) is now providing the public with remote check-in options and virtual waiting room option (known as Remote Queueing). Those who choose to do so can receive notifications about their place in line and when to enter the lobby to receive service via cell phone text (which are also known as SMS messages).
If you opt-in for Remote Queueing, we will send you a text message confirming your enrollment.
BMV will NEVER ask you to send your driver's license number, bank account information, date of birth, or home address, to BMV via text. While you will be able to send texts to BMV, these texts will likely be limited to answering using options provided in your text messages from the BMV. If you do receive a text asking for personal information, it will not have come from BMV and may very well be an attempt by an outside party to obtain your personal information for illegal or unauthorized purposes, such as identity theft. So, you should never respond to texts purporting to be from BMV which ask you to send your personal information via a text reply.
Any and all of the services and information provided to you via our Remote Queueing services is also available via other means, such as online and at BMV locations. So, texting is not meant to replace other tools and options.
By entering your mobile phone number(s) and successfully activating Remote Queueing, (i) you acknowledge and represent to BMV that you are the authorized user of the mobile phone(s) that you link to the Remote Queueing services or have been granted permission by the authorized user of the mobile phone(s) to enroll such mobile phone(s) in the service; (ii) you grant BMV express permission to send text messages to that (those) mobile phone(s) through your wireless phone carrier unless and until such permission is revoked in accordance with these terms and conditions; and (iii) by granting such permission to BMV you are hereby requesting to receive such messages in spite of the fact that your number may otherwise be on the federal or state do not call list, and you agree, to the maximum extent permitted by law, that such text messages shall not be in violation of such do not call list(s).
Activate: You can start using Remote Queueing in one of three ways. (1) You can sign up on the BMV website. (2) You can sign up using a kiosk located within a BMV location. (3) You can scan a QR code located at your BMV location. (4) You can text the terms or phrase provided at your BMV location to 24706.
Stop Remote Queueing: Remote Queueing SMS services can be cancelled at any time by texting "STOP" to 24706 from your mobile phone. Upon BMV's receipt of your cancellation request, BMV will make reasonable attempts to send you a reply text confirming your cancellation. After confirming, we will no longer send Remote Queueing messages, and we will not contact you through text for this feature.
BMV will reasonably endeavor to comply with other text communications sent to 24706 in which you indicate a clear and unmistakable intent to revoke your prior permission; however, you hereby release BMV from any liability for your efforts to revoke your permission via a text message to 24706 that does not strictly comply with the terms stated in the first sentence of this paragraph.
Pricing: BMV does not charge a fee for Remote Queueing services. However, as your cell phone company may assess text messaging fees and data charges, you will need to check with your wireless phone carrier for your plan details, including any text message and data rates that may apply.
Message frequency: Message frequency varies based on the responses received.
Changes in terms: BMV reserves the right to change these terms or cancel the Remote Queueing services at any time. Please check these Terms and Conditions on a regular basis for changes. Your continued use of the Remote Queueing services after changes are posted will mean that you have accepted the terms as modified. In the event BMV decides to withdraw or terminate Remote Queueing services, BMV will attempt to provide reasonable advance notification to any affected parties. However, BMV may withdraw or terminate Remote Queueing services immediately, and without prior notice, if necessary, to comply with law, protect security, combat fraud, or any other reasonable grounds, irrespective of whether or not those grounds are set forth in this document.
No warranties: BMV makes no representations or warranties whatsoever regarding Remote Queueing services. BMV hereby disclaims all warranties, including any implied representations or warranties of merchantability or fitness for a particular purpose.
Limitation of Liability: To the maximum extent permitted by applicable law, you hereby agree that BMV shall not be liable for any direct, indirect, consequential, special, incidental, punitive, or any other damages, even if BMV has been advised of the possibility of such damage or loss, arising or resulting from or in any way relating to your use of Remote Queueing services. Furthermore, BMV shall not be liable for the acts or omissions of third parties, including but not limited to delays in the transmission of messages due to circumstances outside of BMV's control. BMV will also have no liability if unauthorized individuals are able to read your texts, as you are solely responsible for ensuring that no one has access to confidential information shown on, or stored in, your cell phone.
Indemnity: To the maximum extent permitted by applicable law, you expressly agree to indemnify, defend, and hold harmless BMV, its directors, officers, employees, servants, agents, representatives, independent contractors, and affiliates from and against any and all claims, damages, liabilities, actions, causes of action, costs, expenses (including reasonable attorneys' fees), judgments, or penalties of any kind or nature whatsoever arising from your use of the service.
In addition, by using this service, you agree that you are solely responsible for any and all information sent to BMV from your mobile phone.
User Conduct: You agree not to transmit content that is unlawful, harmful, threatening, abusive, vulgar, obscene, defamatory, libelous, or otherwise inappropriate using BMV Remote Queueing services. Violation of this provision may result in BMV canceling your participation in Remote Queueing services.
Governing law: These terms shall be construed in accordance with the laws of the State of Ohio, and any proceedings to enforce or interpret the terms hereof may be brought only in the jurisdiction of Franklin County, Ohio.
